Terms of service

These terms are the agreement between you and More Creativity Limited (company number 06748971, registered at Unit 1h Grovemere House, Lancaster Way Business Park, Ely, Cambs, CB6 3NW) for using timemellow — this website and the app at app.timemellow.com. If you subscribe, you buy from Paddle, our payment partner, rather than from us, and both sets of terms apply: Paddle's to the purchase, these to the software.

The plans

Free is the whole app, running locally in your browser, at no charge and with no account. Your data stays on your device — which makes it simple, and ties it to that browser. Sync is a paid subscription that adds cross-device sync, server-side backups and overview emails. Teams is planned and not yet on sale; these terms will be updated before it launches.

Export works on every plan, including the free one, and we will not gate it. Import too — you can move your data in or out at any time, on any plan.

Your account

You need an account only for Sync. Keep your sign-in details to yourself; you are responsible for what happens under your account. An account is for one person — sharing one set of credentials around a team is what the Teams plan will be for. You must be at least 16 to hold an account.

Your data stays yours

Everything you enter remains yours. You grant us only the licence we need to store, back up, sync and display it back to you — nothing broader, and nothing that would let us use your content for any other purpose. We do not sell it, mine it or hand it to anyone to train their models on, and we do not read it except in the two narrow cases the privacy policy spells out: a support investigation you have asked for and agreed to, or a lawful order we cannot refuse.

You can export the lot as a single JSON file at any time, on any plan, and you can ask us to delete it.

Buying, renewing and cancelling

Subscriptions are sold and billed by Paddle, acting as Merchant of Record. Your purchase contract is with Paddle under its buyer terms; Paddle takes the payment, handles the tax and issues the invoice. These terms are the supplier agreement that buyer terms refers to — they govern your use of the software itself.

Subscriptions renew automatically until you cancel. You can cancel any time from the billing portal linked in the app — no email needed, no retention flow: Sync continues to the end of the period you have paid for, and then the app returns to the Free plan and keeps working locally. Current prices, plus any applicable tax, are shown at checkout — that is the binding figure, not anything quoted elsewhere. If we ever raise prices, existing subscribers get notice before their next renewal rather than a surprise.

Refunds have their own page: refund policy. Statutory withdrawal and refund rights apply on their own terms and are not reduced by anything in these terms.

What happens when Sync ends

Whether you cancel or a payment simply fails, the outcome is the same and it is deliberately gentle. Nothing is deleted. Your data on our servers stays readable, exportable and restorable; what stops is the ability to write new changes to it. The app carries on locally on your device, and if you resubscribe, everything is where you left it. If you would rather your server-side copy were gone, ask us and we will delete it.

Backups and your numbers

Export is the backup you own, and it is there on every plan. Sync adds server copies and automatic backups on top, but no backup scheme replaces one under your own control: decide the export cadence you are comfortable with and keep to it — especially on Free, where the copy in your browser is the only copy there is. If anything ever goes wrong between your device and our servers, the export you took is what makes it a non-event.

Reports and totals are calculated from what you enter — including any rates and currency you attach — and it is your responsibility to check figures before relying on them: before invoicing from an export, filing anything, or making decisions on the numbers. timemellow is a record-keeping tool; nothing it produces is accounting, tax or professional advice.

Fair use

Do not attempt to breach security or access another account; do not use Sync storage as a general file store; do not resell access; do not use the service for anything unlawful; and do not hammer the service with automated traffic. Storage per account is generous for time tracking but not unlimited, and the app will warn you long before any limit matters.

What you enter is your responsibility. You must have the right to store it, and storing or using it through timemellow must comply with the laws that apply to you, to us and to your use of the service. It must not infringe anyone else's intellectual property, privacy or other legal rights. And timemellow is a time log, not a vault: do not use it to store payment card numbers, government identifiers, passwords or the like — it is not built to protect that kind of information, and you accept the additional risks created by using it that way.

Availability, maintenance and changes to the service

We build timemellow to be available around the clock: it runs on globally distributed infrastructure chosen for exactly that, and uptime is something we take personally. What we cannot do is guarantee it. Parts of what the service depends on sit outside our control, and downtime — ours or a provider's — can happen at any hour. We do not promise a specific level of availability, and the service is provided "as is" and "as available", without warranties of fitness for a particular purpose beyond those the law requires us to give.

There will occasionally be maintenance windows when Sync is unavailable. The app is built so that this matters as little as possible: it keeps working on your device without a connection, and entries made during an outage or a maintenance window catch up on their own once Sync is back.

Software changes. We may add, alter or retire features; where a change materially removes something you rely on, we will give reasonable notice, and export will always be available so you are never cornered by it.

Suspension and ending the agreement

You can stop using timemellow whenever you like — export first. We can suspend or close an account that breaks these terms. We will give notice where reasonably possible, unless the breach requires immediate action or giving notice would be unlawful. That includes unlawful content: we do not monitor entries, and if a valid legal order requires us to remove content, suspend an account or assist an authority, we will act as the privacy policy describes. If we close your account for reasons other than your breach, we will refund the unused part of any period you have paid for.

Liability

To the extent the law allows, our total responsibility to you for any claim is limited to the amount you paid for Sync in the 12 months before it arose. We are not responsible for indirect or unforeseeable loss, for lost profits, or for loss you could reasonably have avoided by checking your records or keeping an export appropriate to your needs.

Nothing in these terms limits responsibility that cannot legally be limited, including for fraud, or for death or personal injury caused by negligence. If you are a consumer, nothing in these terms affects your statutory rights.

Our software and brand

The app, this site, the timemellow name and the mark belong to More Creativity Limited. You get a personal, non-exclusive, non-transferable licence to use the service under these terms — you must not copy, resell, reverse-engineer or rebrand it, except where applicable law permits and that permission cannot legally be excluded. Your data is a separate matter entirely, and is covered above.

Third-party services

timemellow relies on a handful of other companies — Paddle for payments, Clerk for sign-in, Cloudflare for hosting, Resend for email, and Sentry for error monitoring. Their terms govern their own services, and if one of them has an outage, the parts of timemellow that depend on it can be unavailable too — outside our control, though the app's offline design keeps the impact small. The privacy policy names them all and says what each one handles.

Changes to these terms

We may update these terms; the date at the top says when. Clarifications and changes that do not reduce your rights simply appear here. Material changes take effect 30 days after we announce them, and Sync subscribers get that notice by email — except where a change is required by law or is urgently needed for security, in which case we give as much notice as circumstances allow. If you do not accept a material change, you can export and cancel, and we will refund the unused part of any period you have already paid for.

Law and disputes

These terms are governed by the laws of England & Wales, and its courts have jurisdiction — except that if you are a consumer resident elsewhere, you keep the protection of your own country's mandatory consumer law and may bring proceedings there. Talk to us first if something has gone wrong; most things are fixable by email.

Odds and ends

If a court decides some part of these terms cannot stand, only that part falls — the rest carries on, and the fallen part is read down to whatever lawful version comes closest to its intent. These terms and our refund policy form the agreement between you and us about using timemellow; Paddle's buyer terms separately govern any purchase, and our privacy and cookie policies explain how we handle information and browser storage. You cannot pass this agreement to someone else; we can transfer it if timemellow ever changes hands, provided your rights under it travel intact.
